About our terms

These terms and conditions ("Terms") govern your use of the website operated by Finney Pharmacy, trading name of The Finney Pharma Ltd. ("we", "our" or "us"). They apply to your access to and use of the website and any associated pages, services or content made available through it (together, the "Site").

By accessing or using the Site, you confirm that you have read and understood these Terms and agree to comply with them. If you do not accept these Terms, you should stop using the Site.

We may update these Terms from time to time to reflect operational, legal or regulatory changes. When updates are made, the revised version will be published on this page and the "Last Updated" date will be amended. By continuing to use the Site after updated Terms are published, you indicate your acceptance of the revised Terms.

Clause 2

Using the Site

The Site is intended to provide information about pharmacy services offered by Finney Pharmacy from 84 Ryhope Road, Sunderland, Tyne and Wear, SR2 9QE, and to allow patients across the UK to nominate us as their pharmacy and book appointments.

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Site.

We make no promise that the Site is appropriate or available for use in locations outside of the UK. If you access the Site from outside the UK, you do so at your own initiative and are responsible for compliance with local laws.

You must not use the Site to carry out activities that are unlawful, fraudulent or harmful, including attempting to gain unauthorised access to the Site or its systems, introducing malicious software, or interfering with the operation or security of the Site. We reserve the right to suspend or restrict access to the Site if misuse is suspected.

Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect, how and why we use it, your rights in relation to your personal information, and how to contact us or the supervisory authority.

Certain elements of the website infrastructure, technology, software and design systems are owned or licensed by PharmAppy Services Limited.

The content of the Site is provided for personal and non-commercial use only. You may not reproduce, copy, modify, distribute or republish material from the Site without prior written permission from us or PharmAppy Services Limited where applicable.

Clause 5

Accuracy of information and availability of the Site

The information on the Site is intended for general information only. We try to make sure that the Site is accurate, up to date and free from bugs, but we cannot promise that it will be. Any reliance you place on the information on the Site is at your own risk.

Content on the Site does not constitute medical advice or a substitute for professional healthcare guidance and should not be relied on as such. If you require medical advice about your health or medication, you should consult a qualified healthcare professional. In an emergency, call 999 or NHS 111.

While we try to make sure that the Site is available for your use, we do not promise that it will be available at all times or that your use of it will be uninterrupted. We may suspend or terminate access to the Site at any time.

To the maximum extent permitted by law, we will not be liable for any loss or damage arising from the use of, or inability to use, the Site, including losses resulting from reliance on information contained on the Site, service interruptions, technical errors, or unauthorised access to Site systems.

If we breach these Terms or are negligent, we are liable to you for foreseeable loss or damage that you suffer as a result. We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud.

Events beyond our control

We are not liable to you if we fail to comply with these Terms because of circumstances beyond our reasonable control.

User responsibilities

By using the Site, you agree that any information you provide will be accurate and not misleading. You also agree that you will not attempt to disrupt the functionality of the Site or use it in a way that could harm Finney Pharmacy, its systems or other users. You are responsible for ensuring that the devices you use to access the Site have appropriate security measures in place.

Indemnity

You agree to indemnify and hold harmless Finney Pharmacy, its employees, partners and affiliates against any claims, damages, liabilities or expenses arising from your misuse of the Site or breach of these Terms.

Clause 11

No third party rights

No one other than us or you has any right to enforce any of these Terms.

Clause 12

Variation

No changes to these Terms are valid or have any effect unless agreed by us in writing or made in accordance with this clause. We reserve the right to vary these Terms from time to time. Updated Terms will be displayed on the Site and by continuing to use the Site following such changes you agree to be bound by any variation made by us. It is your responsibility to check these Terms from time to time.

We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with us, please contact us as soon as possible using the details below. You may also contact the General Pharmaceutical Council (GPhC) as our regulator.

Clause 14

Governing law

These Terms are governed by and interpreted in accordance with the laws of England and Wales. Any disputes relating to these Terms or the use of the Site will fall under the jurisdiction of the courts of England and Wales.
